1. Agreement to Terms
By downloading, accessing, or using the Elevate mobile application ("App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the App.
We may update these Terms from time to time, and your continued use of the App constitutes acceptance of those changes. These Terms constitute a legally binding agreement between you and Elevate regarding your use of the App and its services.
2. Description of Service
Elevate is a habit tracking application that helps users build and maintain positive habits through:
- Unlimited habit tracking
- Visual progress insights
- Calendar view and streak tracking
- Daily routine planning
- Cross-device synchronization
Elevate is designed for personal productivity and habit tracking purposes. It is not intended to provide medical, psychological, or therapeutic advice.
3. Account Registration
To use certain features of the App, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
You must be at least 13 years old (or the minimum legal age in your country) to create an account or use the App.
4. Subscription and Payment
4.1 Subscription Plans
Elevate offers the following subscription options:
- Monthly: $5.00 per month
- Yearly: $50.00 per year
- Lifetime: $180.00 one-time payment
4.2 Automatic Renewal
Monthly and yearly subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
4.3 Managing Subscriptions
You can manage and cancel subscriptions through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period.
4.4 Refund Policy
All purchases are processed through the Apple App Store or Google Play Store. Refund requests must be made through the respective platform according to their refund policies. We do not have direct control over refunds processed by these platforms.
4.5 Payment Processing
All payments are securely processed through the Apple App Store or Google Play Store. We do not collect or store your credit card or billing information.
5. User Conduct
You agree not to:
- Use the App for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Remove or modify any proprietary notices or labels
- Use the App to transmit harmful code or malware
You agree not to use the App in a manner that infringes on the rights of others or violates applicable data protection, intellectual property, or privacy laws.
6. Intellectual Property
The App, including all content, trademarks, logos, and software, is the exclusive property of Elevate or its licensors and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of your data. By using the App, you grant Elevate a limited, non-exclusive, and revocable license to process and display your data solely to operate and improve the App.
7. Data and Privacy
Your use of the App is governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not guarantee that the App will meet your specific expectations or that results from using the App will be accurate or reliable.
You use the App at your own risk.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
In no event shall Elevate's total liability exceed the amount you paid (if any) in the 12 months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other users, us, or third parties
- Violates applicable laws or regulations
Upon termination, your right to use the App will immediately cease. Your account and associated data may be permanently deleted in accordance with our Privacy Policy.
You may also delete your account at any time through the App settings.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material updates via in-app notice or email and by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
13. Dispute Resolution
Any dispute arising from these Terms will be resolved through binding arbitration conducted in California, United States, under the rules of the American Arbitration Association (AAA). Each party shall bear its own costs unless otherwise required by law. Either party may seek injunctive relief in court for violations of intellectual property rights.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
15. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Elevate and supersede any prior agreements regarding your use of the App.
16. App Store Terms Compliance
If you download the App from the Apple App Store or Google Play Store, you acknowledge that those platforms are not responsible for the App's performance or content. Your purchase and refund rights are governed by the respective platform's terms.
