Affiliate Program Terms

1. Program Overview
The Elevate Affiliate Program ("Program") allows approved participants ("Affiliates") to earn commissions by referring new paying customers to Elevate. By applying to or participating in the Program, you agree to be bound by these Affiliate Program Terms ("Affiliate Terms") in addition to Elevate's Terms of Service and Privacy Policy.
Participation in the Program is subject to application and approval at Elevate's sole discretion. Approval is not guaranteed, and Elevate may decline any application without explanation.
2. Eligibility
To be eligible for the Program, you must:
- Be at least 18 years of age
- Have a valid Elevate account
- Have an active online presence (website, social media, newsletter, podcast, or similar)
- Not be an employee, contractor, or immediate family member of an Elevate employee
- Comply with all applicable laws and regulations in your jurisdiction
You may not participate in the Program if you are located in a jurisdiction where participation would violate local law.
3. Referral Links and Tracking
3.1 Your Referral Link
Upon approval, you will receive a unique referral link (e.g., elevate.app/join/your-code). You must use this link to be eligible for commission on referrals.
3.2 Attribution Model
Elevate uses a first-touch attribution model. The first affiliate whose referral link a new user clicks receives attribution credit for that user, regardless of any subsequent affiliate links the user may visit.
- Attribution is assigned at account creation and locked permanently
- Attribution is valid for 30 days from the user's first click on your referral link
- If the user does not create an account within 30 days, attribution expires
- Self-referrals are not permitted — you may not use your own referral link
3.3 Eligible Conversions
A referral is eligible for commission when the referred user:
- Created their Elevate account via your referral link
- Has not previously had an Elevate subscription
- Completes a paid subscription purchase (monthly, yearly, or lifetime)
- Is not the Affiliate themselves
4. Commissions
4.1 Commission Rate
Your commission rate is set at the time of approval and displayed in your affiliate dashboard. Elevate reserves the right to adjust commission rates for future referrals with 30 days' notice. Changes do not affect commissions already earned on existing referrals.
4.2 Commission Lifecycle
Commissions move through three states:
- Pending — created when a qualifying purchase is made. Held for 7 days to allow for refund reversals.
- Earned — confirmed after the 7-day window has passed without a refund. Eligible for payout.
- Paid — included in a monthly payout disbursement.
4.3 Refunds and Chargebacks
If a referred user receives a refund or initiates a chargeback, the corresponding commission will be reversed regardless of its current status. If a commission has already been paid out, Elevate will deduct the reversed amount from a future payout. If no future payout is sufficient, Elevate may request repayment directly.
4.4 Subscription Renewals
Commission is earned on the initial purchase only. Recurring subscription renewals do not generate additional commissions unless otherwise specified in a separate written agreement.
5. Payouts
5.1 Payout Schedule
Earned commissions are paid out monthly. Payouts are processed in the first week of each calendar month for all commissions that reached "Earned" status in the prior month.
5.2 Payout Methods
Elevate currently supports payouts via PayPal, bank transfer, and crypto. You are responsible for providing accurate payout information in your dashboard. Elevate is not liable for payments sent to incorrect or outdated payout details provided by you.
5.3 Taxes
You are solely responsible for reporting and paying any taxes owed on commissions received. Elevate may request tax documentation (e.g., W-9 or W-8BEN) before processing payouts and may withhold payments until documentation is provided.
6. Prohibited Conduct
As an Affiliate, you must not:
- Use your own referral link to sign up for Elevate
- Incentivize clicks or sign-ups with cash, prizes, or other rewards not approved by Elevate
- Use spam, unsolicited messages, or deceptive advertising to promote Elevate
- Misrepresent Elevate's features, pricing, or policies
- Make false earnings claims or guarantees on behalf of Elevate
- Place ads on keywords that include "Elevate" or our brand terms without prior written approval
- Use cookie stuffing or other fraudulent tracking methods
- Operate multiple affiliate accounts
- Promote Elevate through content that is illegal, harmful, hateful, or misleading
Violation of any of the above may result in immediate termination and forfeiture of unpaid commissions.
7. Brand and Trademark Use
Elevate grants you a limited, non-exclusive, non-transferable license to use the Elevate name and approved brand assets solely for the purpose of promoting your affiliate referral link. You must:
- Use only approved brand assets provided by Elevate
- Not modify, alter, or create derivative works from Elevate's brand assets
- Clearly disclose your affiliate relationship in all promotional content (e.g., "#ad", "affiliate link", or "I earn a commission")
- Comply with applicable advertising disclosure laws (FTC guidelines in the US, ASA guidelines in the UK, etc.)
This license is revoked immediately upon termination of your participation in the Program.
8. Relationship of Parties
You are an independent contractor, not an employee, agent, partner, or joint venturer of Elevate. You have no authority to bind Elevate to any agreement or obligation. Nothing in these Affiliate Terms creates any employment, agency, or fiduciary relationship between you and Elevate.
9. Suspension and Termination
9.1 By Elevate
Elevate may suspend or terminate your participation in the Program at any time, with or without cause, with or without notice. Grounds for immediate termination include but are not limited to violation of these Affiliate Terms, fraudulent activity, or conduct that damages Elevate's reputation.
Upon termination for cause, all unpaid commissions may be forfeited. Upon termination without cause, earned commissions (those past the 7-day pending window) will be paid in the next regular payout cycle.
9.2 By You
You may withdraw from the Program at any time by contacting us at [email protected]. Earned commissions will be paid in the next regular payout cycle.
10. Modifications to the Program
Elevate reserves the right to modify, suspend, or discontinue the Program or these Affiliate Terms at any time. Material changes will be communicated via email or your affiliate dashboard with at least 14 days' notice where practicable. Your continued participation after changes take effect constitutes acceptance of the updated terms.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN THE PROGRAM, INCLUDING LOSS OF EXPECTED COMMISSIONS. ELEVATE'S TOTAL LIABILITY UNDER THESE AFFILIATE TERMS SHALL NOT EXCEED THE TOTAL COMMISSIONS PAID TO YOU IN THE THREE MONTHS PRECEDING THE CLAIM.
12. Governing Law
These Affiliate Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in accordance with the dispute resolution process set out in Elevate's Terms of Service.
